Construction Site Runoff Control

Construction site runoff is a potential source of pollutants when it rains. The most likely pollutant is sediment — soil that washes off disturbed ground at a construction site. For that reason, local ordinances now require submittal of a Storm Water Pollution Prevention Plan (SWPPP) and implementation of erosion and sediment control measures on construction sites disturbing one acre of soil or more.

The local ordinances have the same requirements as the state's Rule 5, but allow for local enforcement and collection of a filing fee.

The county ordinance covers the towns of Bristol, Middlebury, Millersburg, and Wakarusa, because development in those towns goes through the county planning department. The three ordinances cover all parts of the county except Nappanee. Nappanee is covered under the state's Rule 5, which means all the requirements apply, but there is no local filing fee or enforcement authority.
