The requirements for submittal of the Stormwater Pollution Prevention Plan (SWPPP) are contained in the Checklist (PDF) that is used for reviewing all plans in Elkhart County. The SWPPP Guidance Document (PDF) contains an explanation of each item contained in the checklist. If your construction site is outside Elkhart County, contact the local authorities to find out if there are additional requirements for plan submittal. (Local ordinances outside of Elkhart County may be more stringent than Rule 5 and may use a different review procedure, but they must follow at least the minimum requirements of the rule.)

Beyond submitting the proper paperwork, requirements of the rule include the following:

  • Sediment leaving the site must be minimized. Appropriate erosion and sediment controls must be used.
  • Appropriate measures must be put in place to prevent pollutants - sediment, trash, fuel, solvents, etc. - from leaving construction sites and entering surface or ground water. This means proper handling and storage of hazardous materials, and spill prevention and clean-up plans in place.
  • Phasing of construction activities must be used, where possible, to minimize disturbance of large areas.
  • Natural features such as wetlands must be protected from pollutants.
  • Areas of disturbed soil that remain inactive for 15 days must have temporary or permanent surface stabilization in place. Usually, this consists of grass seed and mulch, but it can also include aggregate cover, erosion control blankets, turf reinforcement mats, or other appropriate stabilization practice.
  • All practices must be monitored and maintained by a trained representative of the owner. Self-monitoring is required weekly and immediately after each half-inch of precipitation. The owner must keep written records of self-monitoring and provide it to the SWCD, IDEM, the MS4 operator, local municipality, or other inspecting authority upon request.
  • A stable construction entrance must be installed, to prevent sedimentation caused by vehicles driving on and off the site.
  • Public and private roads must be kept clear of sediment. Any sediment that gets on the roads must be swept up, not flushed with water.
  • Properly-located concrete washout areas must be posted and used to prevent contamination.
  • The owner must post a notice at the entrance to the site containing the NOI, permit number, contact information for the owner, and location of the SWPPP.
